These Terms of Service ("Terms") govern your use of HablaDay, operated by OrekunMedia ("we", "our", "us"), accessible at habla.day as a web app (PWA) and as a native iOS app on the Apple App Store. By using HablaDay you agree to these Terms.

1. The service

HablaDay is a Spanish vocabulary learning application that uses spaced repetition, audio playback, and pronunciation feedback to help you learn the most common Spanish words. The service is available as a Progressive Web App (PWA) at habla.day and as a native iOS app downloadable from the Apple App Store.

2. Eligibility

You must be at least 13 years old to use HablaDay. By using the service you represent that you meet this requirement. If you are under 18, you represent that you have the permission of a parent or guardian.

3. Account

HablaDay uses anonymous authentication — you do not need to create an account with an email or password. A random user ID is created automatically when you first use the app. You are responsible for maintaining access to your device, as your progress is tied to that anonymous ID.

4. Free tier and Premium subscription

HablaDay offers a free tier and a paid Premium tier. The free tier provides access to:

• All 300 core Spanish words across 7 layers (layers unlock progressively)
• 2 example sentences per word
• Basic pronunciation feedback (pass/fail)
• 1 voice set

Premium unlocks additional features including immediate access to all 7 layers, detailed pronunciation scoring, additional voice sets, extra example sentences, Streak Shield, and more.

5. Payments and subscriptions

Premium is available as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Payment is processed through one of two routes depending on how you purchase:

• Web / PWA purchases — payments are processed by Stripe. By purchasing this way you agree to Stripe's Privacy Policy and terms.
• iOS App Store purchases — payments are processed by Apple Inc. via In-App Purchase (IAP). By purchasing this way you agree to Apple's Media Services Terms and Conditions.

Subscription auto-renewal (iOS App Store purchases):

• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Payment will be charged to your iTunes Account at confirmation of purchase.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as your original subscription.
• Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings in the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

Cancellation and refunds:

• Web / PWA subscriptions: Cancel at any time from your profile; cancellation takes effect at the end of the current billing period. Refunds are available within 14 days of purchase if you have not made substantial use of Premium features — contact [email protected].
• iOS App Store subscriptions: Manage or cancel your subscription in your iPhone's Settings → Apple ID → Subscriptions. Refunds for IAP purchases are handled by Apple — contact Apple Support at reportaproblem.apple.com.
• Lifetime (web only): A one-time payment that grants permanent access to all Premium features for the lifetime of the product. Refunds within 14 days if not substantially used.

Prices are displayed in the relevant currency for your region at the time of purchase and include applicable taxes.

6. Apple End User Licence Agreement

For copies of HablaDay downloaded from the Apple App Store, the following additional terms apply:

• These Terms are between you and OrekunMedia only, and not with Apple Inc. Apple is not responsible for HablaDay or its content.
• OrekunMedia, not Apple, is solely responsible for HablaDay and the services it provides.
• Apple has no obligation whatsoever to provide any maintenance or support services with respect to HablaDay.
• Apple is not responsible for addressing any claims by you or any third party relating to HablaDay, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
• Your use of HablaDay must comply with Apple's App Store Terms of Service.

7. Intellectual property

All content in HablaDay — including the vocabulary data, audio recordings, example sentences, software, and brand assets — is owned by OrekunMedia or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

8. Acceptable use

You agree not to:

• Use HablaDay for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract our content or data at scale
• Interfere with or disrupt the service or its servers
• Attempt to bypass premium restrictions through technical means
• Share or resell access to your account

9. Disclaimer of warranties

HablaDay is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that it will produce any specific language learning outcomes. Language learning results depend on the effort and consistency of the individual user.

10. Limitation of liability

To the fullest extent permitted by law, OrekunMedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of HablaDay. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate access to HablaDay at any time for violation of these Terms. If we discontinue the service, subscribers will receive a pro-rata refund for any unused paid period.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date. Continued use of HablaDay after changes constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
